Legal Counsel for Bargaining Council - Collective Labour Law - Midrand
Our client is looking for a Legal Counsel to administer legal, regulatory and compliance processes.
Minimum Qualifications and Experience:
- LLB degree or equivalent qualification
- Admission as an Attorney or Advocate in South Africa
- At least 8 - 10 years’ experience in labour law (excluding years of articles/pupilship)
- At least 5 years’ practical experience in litigation
- At least 5 years’ Public Entity experience
- Experience in dealing with Department of Employment and Labour practices,
- Bargaining Councils, CCMA, Labour Court with appearance at the Labour Appeal Court & High Court being advantageous.
- In possession of a current valid driver's license and own reliable vehicle.
Duties & Responsibilities
- Develop, implement, and manage legal strategies and frameworksfor the Council.
- Establish an effective reporting system regarding legal and risk matters.
- To draft and review legal communication and documentation including but not limited to litigation, affidavits, review applications, contracts, SLAs etc.
- Conducting and processing of all litigation processes from inception to conclusion.
- Overseeing the Exemptions and Appeals processes.
- To oversee, manage and monitor the enforcement process once arbitration awards reach Legal Department and onwards.
- To assist with arbitrations when required in consultation with relevant parties.
- Handling rescission applications
Knowledge & Expertise
- Extensive knowledge of labour law legislation CCMA/Labour Court Matters expertise
- Knowledge of Collective Bargaining
- Interpretation and Application of the Main Collective Agreement
- Legal Drafting
Competencies:
- Planning and organising competencies
- Good communication skills - both verbal and written
- Technical knowledge of Labour / Employment Law
Salary: Market Related
